  • nigel gibbon & co was originally set up by Nigel Gibbon in 1999.

     

    Nigel is a qualified solicitor, with 25 years’ experience in disputes with HMRC and appeals to the Tax Tribunal.

     

    He qualified as a solicitor in his native Cardiff in January 1984 and joined the Solicitor’s Office of HM Customs & Excise (as was) 3 years later in January 1987. In 1990 he was asked to set up the VAT Appeals division of the HMC&E Solicitor’s Office in Manchester and he was head of that division until he left in late 1996 to join a national top-10 lawfirm as Head of Indirect Tax, in which capacity he advised clients of the firm in VAT and other indirect taxes on a national and pan-European basis through the firm’s offices in Manchester, London, Leeds and Brussels.

     

    In 1999 Nigel formed  Nigel Gibbon & Co, dedicated exclusively to litigation against HMC&E (now HMRC), with the specific aim of assisting accountants and tax practitioners to provide a comprehensive and cost effective litigation and advocacy service to their clients.

     

    Nigel has represented many and varied businesses, large and small, in Appeals to the Tax Tribunal involving a huge range of VAT, Customs Duty and Excise Duties issues and in further appeals to the High Court and Court of Appeal as well as representing MyTravel plc in a ground-breaking case before the European Court of Justice in Luxembourg. 


    He is probably the most experienced advocate in the country in the presentation of Appeals to the Tax Tribunal, having conducted over 1000 cases all told.

     

    Chris Owen joined Nigel’s litigation team in 2006 following an extensive career in HMC&E/HMRC, predominantly in VAT but also including several years in Excise policy and 8 years in the Solicitor’s Office where he represented the Department in Appeals before the Tribunal. He is particularly experienced in penalty, surcharge and security cases, which is why Nigel head-hunted him to join the litigation team.

     

    Alan Henderson assists us in Customs Duty or Excise Duties cases. He runs his own independent Customs Duty consultancy and has an almost encyclopaedic knowledge of Excise and Customs procedures and issues. Alan spent over 20 years in HMC&E before joining KPMG in the 90s where he advised major businesses on Excise and Customs matters for several years. He then founded his own consultancy and he has helped Nigel with many cases over the years, especially involving duty preferences, tariff classification, anti-dumping duty and breweries / distilleries.

     

    Alex McLoughlin is a leading expert on EU/US export controls and World Trade policy, as well as International Customs Law. He has assisted Nigel in several long and difficult cases, more often than not on export control issues but including one Customs Duty case (which lasted almost 5 years) in which the issue was whether tuna fish caught in the south Pacific ocean were of Turkish origin or not!  Alex is based inKingston in Surrey.
